Public offer
1. General Provisions
1.1. This Agreement is an official offer (public offer) of IE Ovcharenko Inga Vladimirovna (hereinafter referred to as the "Contractor") for a fully capable individual who has reached 18 years of age (hereinafter referred to as the "Customer"), who will accept this offer, on the conditions below.
1.2. In accordance with paragraph 2 of Article 437 of the Civil Code of the Russian Federation (Civil Code of the Russian Federation), if the conditions set out below are accepted and the payment for services is made, an individual who accepts this offer becomes a Customer (in accordance with paragraph 3 of Article 438 of the Civil Code of the Russian Federation, acceptance of an offer is equivalent to concluding an Agreement on the conditions set forth in the offer).
1.3. The moment of complete and unconditional acceptance by the Customer of the Contractor's proposal to conclude an Offer Agreement (offer acceptance) is the fact of confirmation of the readiness to pay for the Contractor's service by clicking the "Pay by card" link on the website http://bride.ru/ph/htcgi/service/membership.html. 1.4. By accepting the Agreement in the manner specified in clause 1.3 of the Agreement, the Customer confirms that he is familiar with, agrees, fully and unconditionally accepts all the terms of the Agreement in the form in which they are set out in the text of the Agreement, including in the annexes to the Agreement, which are his integral part.
1.5. The Customer agrees that the acceptance of the Agreement in the manner specified in clause 1.2 of the Agreement is the conclusion of the Agreement on the terms set forth therein.
1.6. The contract cannot be revoked.
1.7. The Agreement does not require seals and / or signing by the Customer and the Contractor (hereinafter referred to as the Parties) and remains legally binding.
2. Subject of the contract
2.1. The subject of this Agreement is the provision of paid information services by the Contractor in accordance with the terms of this Agreement.
2.2. The Customer fully accepts the terms of the Agreement and pays for the Contractor's services in accordance with the terms of this Agreement.
3. Payment for Services
3.1. The cost of services under the Agreement is determined in accordance with the current prices and is registered on the website http://bride.ru/ph/htcgi/service/membership_rus.html
3.2. The cost of the service can be changed by the Contractor unilaterally.
3.3. The methods of payment for the service are indicated when making the payment.
4. Intellectual property
4.1. All textual information and graphic images on the site are the property of the Contractor or other third parties.
5. Special conditions and responsibility of the parties
5.2. The Contractor is released from liability for violation of the terms of the Agreement if such violation is caused by force majeure circumstances (force majeure), including: actions of state authorities, fire, flood, earthquake, other acts of God, lack of electricity, strikes, civil unrest, riots, any other circumstances, not limited to those listed above, that may affect the performance of the Agreement by the Contractor.
5.3. The Contractor is not responsible for the quality of public communication channels or services that provide the Customer with access to his services.
6. Confidentiality and protection of personal information
6.1. The Contractor undertakes not to disclose the information received from the Customer.
6.2. It is not considered a violation of obligations to disclose information in accordance with reasonable and applicable legal requirements.
6.3. The Contractor receives information about the IP address of the visitor to the Site http://bride.ru/ and his email. This information is not used to identify the visitor.
6.4. The Contractor is not responsible for the information provided by the Customer on the website in a public form.
7. Procedure for consideration of claims and disputes
7.1. The Customer's claims for the services provided are accepted by the Contractor for consideration by e-mail within 10 (working) days from the moment the dispute arises.
7.2. When considering disputable situations, the Contractor has the right to request from the Customer all the documentation of interest regarding the event in question. If the Customer fails to provide documents within 1 business day after the day of the request, the claim is not subject to consideration by the Contractor.
7.3. The Contractor and the Customer, taking into account the nature of the service provided, undertake, in the event of disputes and disagreements related to the provision of services, to apply the pre-trial procedure for resolving the dispute. If it is impossible to resolve the dispute out of court, the parties have the right to go to court.
8. Other conditions
8.1. The customer has all the rights and powers necessary for the conclusion and execution of the Agreement.
8.2. The customer has the right to unilaterally refuse the services of the Contractor at any time. In the case of unilateral refusal of the Customer from the services of the Contractor, the payment made is not refundable.
8.3. The Contractor reserves the right to change or supplement any of the terms of this Agreement at any time by publishing all changes on its website.
8.4. On all issues not regulated by this Agreement, the parties are guided by the current legislation of the Russian Federation.
8.5. The recognition by the court of the invalidity of any provision of this Agreement and the rules does not entail the invalidity of the remaining provisions.
